Advocate Shailendra Mani Tripathi filed a petition in the Supreme Court for women to get leave at the workplace during periods
In some countries, this step is being taken so that women get equal opportunities to work. Women need more support regarding safety and late going to the office. That's why those demanding to make the workplace more gender equal are demanding these holidays.
In the case of period leave, many companies are changing their policy. At the same time, the debate about this is going on all over the world. Women believe this is their need, while for some; it is an excuse to take a holiday or a joke. This article will teach you all the essential things related to the period. Do share the article further.
What is menstruation?
- Due to changes in the body due to hormones, there is discharge from the uterus, called menstruation. This process takes place every 25-30 days.
Are period pains an excuse?
- Symptoms related to periods are different for every girl and woman. In many surveys, 80 to 85% of women admitted to having painful periods. Periods are not just limited to pain. Women or girls face many problems on the first-second day of their periods. Many symptoms like excessive pain, heavy bleeding, vomiting, cramps, breast tenderness, mood swings, headache, and migraine are seen in women.
- Women have such severe pain that they have to give injections. Endometriosis fibroids cause severe pain. The first day is a difficult time for most of the girls. At the same time, many girls’ resorts to painkillers for the first two days. Eating painkillers for a long-time harm’s health.
Women are unable to work for two days a month due to pain:
- About 81% of 32,000 women in the Netherlands involved in a study published in the BMJ, the journal of the British Medical Association, said that their productivity was reduced by about 23 days of work during the entire year due to discomfort during periods. Or say that these women were troubled by the pain of periods for two days every month.
- Even though companies worldwide are now making policies for working women on menstruation days, this concept is not new. The concept of period leave has existed worldwide in varying forms for at least a century.
- Firstly, the Soviet Union took the initiative on this issue. A national policy was introduced in the Soviet Union in 1922, in Japan in 1947, and in Taiwan and Indonesia in 1948. This policy was made for the women working in the factory. These women used to get three days of paid leave during that time. The motive behind this holiday was to save women's reproductive health so that all the country's citizens remain healthy.
Companies look at their pros and cons before hiring a woman:
- Be it period leave or maternity leave, companies have a profit-loss perspective on it. While offering jobs, girls are often asked, 'Aap shaadi toh nahi karne hai?'
- There is also a matter of periods in the mind of the companies. They also feel that if there is a girl, she will also have house responsibilities. In such a situation, companies prefer to hire male candidates considering their productivity while offering girls jobs.
For the first time in India, women got period leave in Bihar:
- Bihar is India's only state that has providing two days of special menstrual pain leave to women since 1992. In 1997, women launched a 32-day agitation for this, after which they got this right. In 1997, seven years after the rule was made in Bihar, Mumbai-based media company Culture Machine started giving one day off.
- In January 2023, keeping in mind the girl students, the government announced giving menstrual leave to the girl students studying in all the state universities under the Department of Higher Education. State Higher Education Minister R Bindu made this announcement. Now girl students of Kerala will get two days' leave during periods.
Women do not take leave due to shame and stigma:
- Women in Japan and South Korea get periods off. But even there, women do not use this holiday. Period leave policy came in Japan in 1947 under Labor Rights Concern.
- Japan's local media reports that in 1965, only 26% of women used this leave. But with time this figure further reduced. The government there conducted a survey in the year 2017, in which it was revealed that only 0.9% of women had applied for period leave.
- Bringing policy is a temporary measure, but changing society's attitude is an important task. In most of the countries that have started this, women are taking this facility equally that their colleagues underestimate or look down upon them somewhere. So somewhere, they are asked for a medical certificate.
- Women work 'round the clock' outside the home; in such a situation, they cannot be given the tag of non-equal by just two holidays. To understand women, we must first accept their existence. When we accept their presence, then it will be easy to understand the problems related to them.
- For us, it will not be a matter of one or two days off but a health-related issue. There is also a truth that when any rule has been made to favor women, a section of men has consistently opposed it. Whether it is dowry abolition, property rights, or now menstrual leave.
What is said in the constitution?
- The 1961 Act provides for almost all the problems women face, which can be understood from its many provisions, which made it mandatory for employers to give certain days to women employees during pregnancy without wages. It has been made compulsory to take leave together. Similarly, leave has been asked for an abortion, tubectomy operation, or in case of any medical complication.
These companies also give leave in India:
- Many companies give period leave to women. In 2020, food delivery company Zomato announced giving a leave period. Presently 12 companies in India are giving period leave. Apart from Swiggy, Byju, Mathrubhumi, Magzter, Wet and Dry, Culture Machine, Industry ARC, Gozoop Online, Horses Stable News, Filmybiz, Jaipurkurti.com also gives period leave to women employees.
- In January 2023, Delhi-based Company Orient Electric, which manufactures electric goods, announced period leave for women employees.
In which countries is period leave available?
- Countries such as the UK, China, Wales, Japan, Taiwan, Indonesia, South Korea, Spain, and Zambia already have some form of holiday to recognize period pain.
A bench headed by Chief Justice DY Chandrachud, while hearing the issue of period leave for women, said that a representation should be made to the Union Ministry of Women and Child Development to decide on it. He also noted that 'period leave is a policy matter in which the Supreme Court will not interfere.' Now it remains to be seen whether period leave will be approved for women by changing the policy.
