Can court marriage be done by signing on the stamp of rupees 500?
In the coming days, you must have read such news in which it is seen that the boy and the girl signed the stamp of Rs 500 and got the court marriage done. But do you know that if someone talks about marriage by signing a 500 stamp in this way, then it is illegal? Yes, there is no recognition of such marriage in the eyes of the law. In this blog, you will know that if a person gets such a marriage done on a stamp of Rs 500, the marriage is not legally valid.
The lives of 45 to 50 boys and girls are put at stake every month with the help of notaries and advocates operating in the courts. But the most deceitful thing in this happens with girls. This is because girls make a relationship by making a false promise of marriage, then they marry them falsely on such a stamp of Rs 500. Due to this, girls feel that they are married, but in reality, such marriage has no value. Boys resort to such stamps or notary marriages to lure girls. And most of the girls get caught in the trap of this paper marriage in the process of court marriage. The most important thing is to see in this that the girls who sign the stamp paper in the name of court marriage include not only rural or less educated girls but also urban girls who are doing jobs. And the most surprising thing in this is that such marriages are illegal in the eyes of the law, but the number of such marriages is increasing instead of decreasing.
Some lawyers are doing this type of illegal work with the connivance of brokers and notaries:
- Many family court lawyers said that the legal work of court marriage by getting the stamp or notary signed is going on in connivance with the brokers and notaries operating in the court.
- In this, the brokers say this and give such greed that you will not have to make any court rounds if you marry like this. And to avoid the whole process of court, they recommend notary marriage.
- In this, some lawyers who do such work for a few rupees and notaries also help them. It is known to all of them that the boy or girl wants or wants to do a nominal marriage to avoid legal action, which they take advantage of.
- The victim girl can also file a fraud complaint against such a lawyer and notary. However, such cases against lawyers are seen only in the courts.
Case 1: If the girl did not get the abortion for the third time, then the young man broke the relationship:
- A girl from Bhopal also became a victim of stamp marriage. The boy called himself the son of the SDM and married the girl on stamp paper. After that, both started living together. In these two years, the girl got pregnant twice and had to have abortions twice.
- The boy did it with her the third time the girl refused to have an abortion. When the girl said we are done, you cannot leave me like this. So, the boy said there was no legal basis for the agreement written on this stamp paper.
- The girl lodged a case of excess against the boy at the police station. The boy has now come out on bail.
- On the other hand, the girl's family came under pressure and said they did not have to fight the case. The girl's family says that when there is no legal basis for this marriage, how will we fight the court case? In the same way, there will be many people who do not even register the case in court for such a false and illegal marriage.
- And in the same way, it does not file any complaint against the notary or brokers who prepare the stamp paper.
Stamp marriage cases are also seen more in the counseling cases in the District Legal Authority, which is increasing continuously. Seven out of ten cases that come for counseling are from such marriages. Among them are educated boys and girls from good families. Every other day a couple comes to the family court, who wants to get married by signing on the stamp paper. Many good lawyers tell them clearly that there is no legal basis for this. After this, they prepare such documents after meeting with some other lawyers. And when the lawyer refuses, a typist or a broker gets the matter made. In this way, the business of marriage on the stamp is going on smoothly.
Case 2: Complained to the police station, Karli ran away on the stamp on marriage:
- This case is also of Bhopal. The girl used to work in a private company. The company manager made a sexual relationship by promising to marry the girl. When the girl became pregnant, the boy refused to marry. When the girl complained to the women's police station, the boy agreed to the marriage.
- The boy got the girl signed on a stamp of 500 in the name of court marriage. Ten days later, the boy took the girl to some unknown hospital, where the doctor told her that she had miscarried. The boy disappeared only 20 days after this incident.
- When the girl again reached the women's police station with the girl's complaint, she was told that there was no legal basis for stamp marriage, so that no action could be taken against the boy.
Marriage, on a stamp of Rs 500, is just an affidavit of living together. Which has no basis in the eyes of the law:
There is no legal basis for marriages on such a Rs 500 stamp. Many times, people deliberately do such weddings to avoid legal trouble. However, there is no mention of marriage anywhere in such papers. It is only an affidavit of living together.
What is Stamp?
- Every person seems to need stamp paper for some work at some point or the other. There is hardly any person who has never had anything to do with stamp paper. Stamp paper is required from the affidavit to the sale deed. These stamp papers act like a note. However, they are not transferred from person to person like a note. It has only one vendor who issues the stamp to the people, and only the person to whom the authorization is issued can use that work.
- Virtually all with legal implications, including transactions including lease agreements, buy-ins, property, business/contract agreements, loan agreements/financial deals, power of attorney, affidavits, articles of association, memorandum of association, indemnity bond, declaration Stamp paper is used to make documents/agreements, bonds, gift deeds, etc. valid and legally enforceable.
- For example, whenever two people do any transaction, the government also has a part in it; we can call that part tax. While buying any immovable property or making any related transfer, we must pay the government some amount. For example, a property must be registered when purchased, so such a registry requires a stamp of a specified amount.
